Terms of Service

These Terms of Service (the "Terms") govern your access to and use of OptimDex and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1. Eligibility & Acceptance
You must be capable of entering into a binding contract in your jurisdiction to use the Services. If you use the Services on behalf of an entity, you represent that you have authority to bind that entity and that the entity accepts these Terms. If you do not agree to these Terms, do not use the Services.
The Services are not intended for children under 13 (or the age of consent in your jurisdiction, if higher), consistent with our Privacy Policy.
2. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the “Effective date” above. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
3. The Services
OptimDex provides tools and features for image conversion and related utilities. We may add, modify, or discontinue features at any time without notice. Certain functionality may depend on third‑party services (e.g., Google Analytics, Google AdSense) or an anonymous session cookie for essential operation.
We do not offer user accounts and we do not process payments; the Services are free to use.
We employ essential error and performance monitoring (Sentry) to maintain stability. This includes collecting technical diagnostics such as anonymized session identifiers (hashed), feature area tags, route identifiers, truncated input previews (first 128 characters), error stack traces, and performance timing. No full file contents, image data, or personally identifiable profile information are collected.
4. Acceptable Use
When using the Services, you agree that you will not:
- Use the Services for unlawful, harmful, infringing, or abusive purposes.
- Interfere with or disrupt the Services or servers, including via automated access beyond reasonable use.
- Attempt to reverse engineer, decompile, or derive source code from the Services, except where permitted by law.
- Circumvent technical measures or security controls, or probe, scan, or test the vulnerability of the Services without authorization.
5. Your Content
You retain ownership of any files or content you submit to the Services. You grant us a limited, non‑exclusive, worldwide, royalty‑free license to use, process, and display your content solely for the purpose of operating the Services and providing requested functionality (e.g., converting images). You represent that you have the necessary rights to submit the content and that it does not violate applicable law or third‑party rights.
6. Intellectual Property
The Services, including software, design, and content provided by us, are protected by intellectual property laws. We reserve all rights not expressly granted. You may not use our trademarks, branding, or logos without our prior written permission.
7. Privacy
Please review our Privacy Policy to understand how we collect, use, and safeguard your information when you use the Services. By using the Services, you acknowledge that your information will be processed as described in the Privacy Policy.

8. Third‑Party Services & Links
The Services may rely on or reference third‑party services and websites. We do not control and are not responsible for third‑party content, policies, or practices. Your use of third‑party services is at your own risk and subject to their terms.
Core observability vendors (currently Sentry for error/performance telemetry and Google Analytics for aggregate usage where permitted) are treated as essential or consentdbased service providers depending on regional requirements. Their collection is limited to the technical scope described in our Privacy Policy.
17. Operational Monitoring
You acknowledge and agree that we may process technical telemetry (e.g., anonymized identifiers, route names, feature tags, truncated input samples, performance timings, and error stack traces) for the legitimate purpose of ensuring availability, security, and reliability of the Services. Such monitoring is strictly limited to service diagnostics and excludes persistent storage of user file contents.
Where required by law, non-essential analytics (e.g., Google Analytics) are subject to consent controls. Error and performance telemetry necessary for core functionality is processed under legitimate interests to keep the Services stable and secure.
9. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR‑FREE, OR SECURE.
10. Limitation of Liability
For data protection reasons, we do not make backups of files you upload or process through the Services. You are solely responsible for creating and maintaining your own backups of your content prior to using the Services. To the maximum extent permitted by law, we are not liable for damages caused by or resulting from your use of the Services.
Under no circumstances will we be liable to you or any third‑party for any loss of use, data, goodwill, or profits, whether or not foreseeable, nor for any special, incidental, indirect, consequential, exemplary, or punitive damages, arising out of or in connection with your use of the Services or these Terms.
Without limiting the foregoing, we will not be liable for any damages, losses, or claims arising from or related to your misconduct, negligence, violation of these Terms, or failure to maintain appropriate backups or safeguards for your content.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Services will cease immediately.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles. You and we agree to submit to the exclusive jurisdiction of the courts of Singapore.
14. Miscellaneous
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision shall not be deemed a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
15. Copyright Policy
We respect the intellectual property rights of others and expect users to do the same. You may only upload or process content for which you have all necessary rights and permissions. If you believe that content processed via the Services infringes your rights, please send a notice to optimdex@gmail.com including the following information:
- Identification of the copyrighted work claimed to have been infringed (or a representative list).
- Identification of the material claimed to be infringing with information reasonably sufficient to locate it (e.g., URL or steps to reproduce within the Services).
- Your contact information (name, address, and email) and a request specifying the action you seek (e.g., removal or disabling access).
- A statement that you have a good‑faith belief that the disputed use is not authorized by the rights owner, its agent, or the law.
- A statement that the information in your notice is accurate and that you are the rights owner or authorized to act on the owner’s behalf.
We may remove or disable access to content alleged to be infringing and may terminate access to the Services for repeat infringers where appropriate. The Services process files transiently; we do not permanently host user content and we do not keep backups. However, to the extent any content is accessible through the Services, we will act on valid notices as described above. If you believe material was removed in error, you may send a response explaining the basis for your authorization to use the content; we may restore access at our discretion.
